New Mco Beauty Launch- Too similar to a popular product? Thoughts?

Hey all!
Mco Beauty have made a series of new launches this week! Two products caught my eye as they are literally copy paste of a trendy product (ahem Charlotte Tilbury)
What are your thoughts on this? Is this wrong of Mco Beauty to literally copy another brand?

    To be honest. Some brands are well known as being copy cats. I appreciate ethildes information, I wouldn’t of known that. Elf, model Co, revolution beauty all copy. Also ideas get copiesld. Hard to prove this… look at all the lip oils and liquid blushes being released.
    I personally love the ct pillow talk lipstick and the lip liner is bomb. I wouldn’t buy the model co version but these days people can afford everything. It looks similar but not exact.

      A principle rule in copyright law (this applies globally) is that ideas cannot be protected by copyright but the expression of an idea can, because it can be original. Multiple people can come up with the same idea but embodying the same expression of an idea is very rare.

      In my industry (and IP is my area of legal expertise), we are well-aware brands like Aldi and Revolution are notorious copycats. Their business models basically entail copying just enough or mimicing the get-up of other brands’ products to get away with selling similar-looking products at a cheaper price in order to target consumers who are looking for cheap dupes. But remember this, the only thing they can get away with copying is the get-up of the brand, not the formulations. I think most of you who have ever purchased Lacura by Aldi, for example, will know exactly what I mean. Even calling it a pale imitation is generous.

        Love this information. Thank you. This is why I’m sick of hearing “dupes” and so on. I’m all for affordable great products that might be similar but overall no. Some people spend so much money on similar or dupe products that they end up spending more on the actual product. Haah

        I purchased all the McoBeauty Beauty Wands. The packaging get-up is definitely close to CT’s, but the formulations are actually different. McoBeauty’s formulations are a lot more pigmented and they are actually quite nice – probably the only product range I would recommend from McoBeauty. However, from a professional perspective, they seem new to the copycat business model, particularly if they are going to adopt a product name that is also similar to CT’s. CT’s IP protection globally is woefully inadequate though, so they are ripe for copycats.

        I like them too. I find the ct makes me look dirty and muddy. Not so these ones.

    I have 2 x black eyeliners by 2 different brands which look identical.
    I have tried a few Mco Beauty products and find they are very good.

    There are only so many designs for a pencil & a lipstick tube: I wouldn’t call it a ripoff; it’s a fairly plain rose gold tube.

    Nude by Nature does a very similar design.

    Maybe they want people to think their product is on par with the more expensive brands? Aldi did a lipbalm with packaging the same as a Dior lip oil as well.

    I own both CT products. The lip pencil is not original enough for anyone to claim some sort of exclusivity in it. To claim exclusivity in the get-up of the lipstick would be hard. I’m not sure it is even original enough (in the copyright sense) to qualify for copyright. You would be looking at an Australian Consumer Law claim but proving reputation in that design would be difficult. If you cannot make out ACL, you are not going to get passing off either, and that action requires proof of damages.

    I understand the average consumer gut reaction to cry copycat but it does not have strong legs to stand up in law.

    Not really sure I would call these copies or rip-offs, particularly the lip pencil (I have seen so many iterations of this type of design and @m8 is also correct about the finite number of ways you can design one differently).

    If CT cares, she needs to register her IP globally (and specifically the get-up) because copyright (usually not required to be registered in most jurisdictions around the world) can be extremely difficult to prove, particularly in the context where there are many other brands who have similar designs for their products, some of which may have pre-dated the launch of her products.
